first_imgLynne Stewart, June 2013The following letter was issued on Aug. 1 by political prisoner Lynne Stewart, who is suffering from breast cancer and is engaged in a struggle to gain compassionate release. Supporters in New York are encouraged to attend a rally on Thursday, Aug. 8, the day of Stewart’s next court hearing, at 1 p.m. outside the New York City Federal Courthouse, 500 Pearl St. in Manhattan (at the Worth Street entrance). The hearing starts at 2:30 p.m. but it takes a long time to clear security, so please arrive early. Bring photo identification.To All:By now we will have filed papers which take us back into federal court in New York City to request that Judge [John G.] Koeltl overturn the barbaric decision by the Bureau of Prisons and allow me to leave this empty loveless prison and go home to people and places familiar and beloved. I certainly am sick enough — even my oncologist revised her prognosis down to 18 months now.However, my spirit remains undaunted and when I compare myself to others far worse off than I am — the Guantánamo and Pelican Bay prisoners; Marie Mason; Aafia Siddiqui; Hugo “Yogi” Pinell; those under the death penalty, like Kevin Cooper; the remaining Angola 2; Ruchel Magee; and my fellow New Yorkers, Jalil [Muntaqim], Sekou [Odinga], Herman [Bell], Seth [Robert Seth Hayes], David [Gilbert], Abdul [Majid] — let me stop before I choke up here — I know we MUST win my fight and the struggle for all other political prisoners to be freed. And then we must struggle for all to be free in this country.How much can we, the people, take? Their austerity is barbaric cruelty, with food stamps gone and public housing unavailable permanently. How long can the 1% continue to rule and the corporations call the shots? There is so much wrong, but we are not allowed to despair since we have been given sight in this land of the blind and hopeless and heartless.So, that said, let’s once again get out there as often as needs be — for all the causes, for all the humanity. In a recent letter from HUD to Senator Robert Menendez, HUD asserts that it has made no policy changes with respect to DACA recipients. HUD’s letter was in response to concerns raised by Senators Menendez, Booker, and others, following a number of news stories that suggested HUD had made a change in policy, barring DACA recipients from getting FHA loans.FHA’s letter restates the position FHA has taken over the last year: longstanding FHA policy prohibits financing to individuals without legal residency status, and therefore there has been no policy change. The question FHA did not answer: are DACA recipients eligible borrowers? That is, do they have lawful residence in the United States? While the underlying policy may not have changed, FHA’s answer evidently has.In the early years of the DACA program, FHA’s enforcement stance was that it was up to the lender to determine whether DACA represents a legal residency status. However, early last summer, they appear to have made an internal determination, based on language from USCIS, that DACA does not provide legal residency. Important to note: the USCIS language does lend itself to other interpretations. While USCIS consistently notes that DACA is not a legal residency status, and does not provide a path to such status, they also state that DACA recipients are “legally present.””Deferred action under DACA does not confer legal status upon an individual and may be terminated at any time, with or without a Notice of Intent to Terminate.” (February 2018) “[…A]lthough deferred action does not confer a lawful immigration status…you are considered to be lawfully present in the United States during that time.” (June 2016)Is legally present the same as lawfully resident? FHA evidently thinks not, and on that basis began advising lenders that DACA recipients are ineligible, and enforcing that interpretation in loan reviews, requesting indemnification on loans where the borrower’s EAD card shows “C33” (indicating a DACA recipient).Lenders who make FHA loans to DACA borrowers should be prepared to make a strong legal case that FHA’s interpretation is wrong and that DACA does provide lawful residence.Editor’s note: The Collingwood Group is a client of the Five Star Institute, the parent company of DS News. Yorkshire win County Finals showdown

first_img20 Sep 2013 Yorkshire win County Finals showdown Yorkshire are England’s champion women’s county. After an absence of two years they made a triumphant return to County Finals, beating Lincolnshire 5-4 in today’s title showdown.In the day’s other matches Hertfordshire beat Gloucestershire 6½-2½ to finish third overall. Kent claimed their first win of the week, defeating Warwickshire 5½-3½ and finishing in fifth place.Yorkshire’s win is their 12th in the championship and their first since 2008 (team image copyright Leaderboard Photography). “I am over the moon with my fantastic team,” said Yorkshire captain Carole Waights, after a tense afternoon of close singles.“Lincolnshire played beautifully this afternoon. They were going straight for the pins and they gave me a fright!” she added.Yorkshire had raced ahead this morning, winning all three foursomes. But Lincolnshire charged out in the afternoon singles. Helen Hewlett and Emilee Taylor both played excellent golf to beat Emma Brown and Becca Wood respectively in the top two singles.Behind them, their battling colleagues were edging ahead – but in the end Yorkshire grit won through and they secured the two points they needed.Charlotte Austwick won the 16th to get back to all square and then, typically for the team this week, finished strongly by winning the 18th.Behind her, Holly Morgan came to the 17th tee one up and, with a solid par, won the hole and clinched the title for Yorkshire. It was the signal for cheers and whoops of delight which echoed around the course.In the second match Hertfordshire were on winning form all day, taking 2½ points in the foursomes and four in the singles. Their winners included 13-year-old Hannah Screen who played extremely well on her debut appearance and won 4/2 in the singles.Their performance put them in third place and their captain, Cathy Shand, said: “We are so chuffed. The team have played their socks off for us this week and they are an absolute credit to Hertfordshire.”In the final match Kent overcame Warwickshire to win their first point of the week. In the foursomes the two teams shared the points with one half and one big win apiece – Kent’s top pair were an estimated eight-under when they won 6/5 and  Warwickshire’s second pair also won on the 13th. Kent pushed ahead in the singles, winning three matches and halving two.Kent captain Chris Daniels said: “We have played as well as we can and today it was fantastic to get 1½  points in the foursomes and then have all those singles matches coming in one after the other.“Overall it’s been a great experience and all the players have notched up a fewe personal pluses. WWF-SA experts estimate that Nedbank’s funding initiative will help release at least 550 000 kilolitres of water into reservoirs each year.WWF-SA Biodiversity Unit manager Dr Deon Nel said the overriding aim is to “ensure that the catchments are able to function properly and release water”.Alien invasive trees and plants grow far more rapidly than indigenous species, posing a threat to biodiversity. “These (alien) trees are spreading across the country, they consume our water,” said Nel.According to the Agricultural Research Council, alien species, such as the Australian black wattle, drastically reduce the volume of water that reaches rivers and dams, as they consume far more moisture than indigenous plants.Industry statistics show that it’s in the interest of South Africa, a water-stressed nation, to exterminate as many of the problematic alien plants as possible to improve water availability.“When one considers that approximately 3 300-million kilolitres of water is trapped by invasive alien species in South Africa, equating to around 7% of the country’s water run-off, it’s easy to understand how important this investment is in improving water security in our country,” said Nedbank CEO Mike Brown.The Enkangala Grasslands and Umgeni are two of five critical water catchments being rehabilitated by WWF-SA’s programmes. The others are Kouga in the Eastern Cape, and the upper Berg and Breede catchments as well as the Garden Route between George and Plettenberg Bay in the Western Cape.Straddling KwaZulu-Natal and Free State provinces, Enkangala Grasslands releases water into the Tugela, Pongola, Usuthu and Vaal rivers.“In addition to increasing water supply, these investments into WWF-SA’s water programmes will also improve water quality, create jobs and contribute to climate change adaptation and resilience,” Nel said.South Africa has a challenge to manage its water resources sustainably to avoid the forecast critical shortage by 2025, which would affect livelihoods and the economy.Jobs and support for farmersNedbank is well-recognised for its role in the “green revolution”, having invested heavily in environmental projects recently. It has also donated more than R80-million ($11.3-million) to 150 major conservation projects since 1990 through its Green Trust.“This new multimillion-rand investment raises our water stewardship efforts to a much higher and more impactful level,” Brown said.The bank predicts that scores of jobs will be created through its latest investment.Up to 230 000 jobs stand to be made available in the water-resource management sector alone in the next few years.Christo Marais, head of operations at the Department of Environmental Affairs’ Natural Resource Management Programme, said the number of jobs depends on public-private investments.Funds worth R57-billion ($8.1-billion) are needed to unlock potential. “This R57-billion is clearly unaffordable for government … The private sector will have to come to the party,” said Marais.
